What is an Energy Performance Certificate?

What is the Energy Label?

Once the Energy Performance Certificate has been submitted and registered, the Energy Label is issued. This is the final document that must be held by the property owner.

The Energy Label contains a summary of the information included in the Energy Performance Certificate.

This label is very similar in appearance to those found on household appliances. It indicates the property’s emissions and energy consumption rating on a scale ranging from A, the most efficient, to G, the least efficient.

Who must obtain the Energy Performance Certificate?

Responsibility for obtaining this certificate lies with the property owner, who must appoint an accredited energy assessor to carry out the certification.

When must the Energy Performance Certificate be displayed?

The Energy Performance Certificate or energy rating must appear in all advertisements and marketing materials relating to the property. Failure to do so may result in penalties.

To display the energy rating of a property, the owner must provide the Energy Label or the Energy Performance Certificate to their estate agent, who must include it in property advertisements and online property portals.

When a property is sold, the owner must provide the purchaser with the Energy Performance Certificate and the Energy Label, and these documents must also be included in the sale and purchase agreement.

In the case of a rental property, the owner must show and provide a copy of the Energy Performance Certificate and the Energy Label to the new tenant.

It is advisable to attach a copy to the tenancy agreement, as a copy of the Energy Performance Certificate will be required when the rental deposit is lodged with the relevant official body.

Penalties for renting or selling without an Energy Performance Certificate

Law 8/2013 of 26 June establishes the penalties for non-compliance with energy certification regulations.

Selling or renting a property without an Energy Performance Certificate constitutes an infringement, and fines may range from €300 to €600.

There are three categories of penalties depending on the seriousness of the infringement.

An infringement may arise from failing to mention the energy rating in property advertisements, selling or renting a property without first obtaining the Energy Performance Certificate, or falsifying its results.

The infringements are classified as follows:

  • Minor infringements are subject to fines ranging from €300 to €600.
  • Serious infringements are punishable by fines ranging from €601 to €1,000.
  • Very serious infringements carry fines ranging from €1,001 to €6,000.
