Opening licences are classified into three main groups depending on their level of risk and environmental impact:
- Responsible declaration for opening — innocuous activities.
- Prior communication of opening licence.
- Opening licence or environmental licence.
This classification is regulated by Law 20/2009 on environmental prevention and control, and by Law 16/2015 on the simplification of the administrative activity of the Administration of the Generalitat and the local governments of Catalonia, and on the promotion of economic activity.
Responsible declaration for opening — innocuous activities.
This is the simplest procedure and replaces the opening licence. In order to carry out this procedure, a competent and registered industrial engineer is required to inspect the establishment and verify that it complies with all current regulations and legislation. If it does not comply, the measures that must be taken to achieve compliance will be indicated. Once everything is correct, the technician will prepare the relevant technical documentation, including a technical certificate for the responsible declaration, and all documentation will be submitted electronically through the website of the corresponding town council. In some cases, an urban planning compatibility certificate must be requested so that the town council can authorise the opening in the chosen location.
This procedure is intended for openings with the lowest environmental impact, mainly shops with a surface area of less than 120 m².
Prior communication of opening licence.
For this prior communication procedure, as in the previous procedure, the intervention of a competent and registered technical engineer is required for the preparation and submission of all documentation to the corresponding town council. In this case, the establishment, whether commercial premises, office or industrial warehouse, must be inspected and brought into compliance with all current regulations. The competent technician must prepare a technical project, report, plans, etc., for the selected establishment, together with the required technical documentation.
Once the premises have been adapted to current regulations, the documentation has been submitted to the corresponding town council and the opening fees have been paid, the business may open.
Opening licence or environmental licence.
This procedure is intended for the most dangerous openings with a high environmental impact.
In this case, a registered industrial engineer is required to oversee the entire implementation process, as well as to prepare the technical documentation required by each town council.
The technician will inspect the establishment and indicate the measures that must be taken to comply with current regulations. A technical project must be prepared and submitted to the town council or to an Environmental Control Entity (EAC). Once submitted, this project must be reviewed and approved. Once everything has been approved, the premises must be adapted according to the specifications of the project approved by the town council or the EAC, in order to subsequently pass the corresponding inspections for your business.
This procedure for obtaining the opening licence is slower than the previous ones, as project approval must first be obtained; then the establishment must be adapted and, afterwards, the required inspections must be passed.
